March 6, 2008 Statement from Sen. Lisa
Brown on today’s Supreme Court ruling
Today, the state Supreme Court ruled that it will not
hear Senate Majority Leader Lisa Brown’s
constitutional challenge on an accelerated schedule. Her
statement follows:
“Today’s news is good news. I only asked for an
accelerated schedule to avoid an outcome similar to the last
time the Court was asked to rule on the two-thirds
requirement. In 1994, the Court declined to rule on the
matter and declared it moot because the Legislature was not
in session.
Today, the Court accepted my lawsuit and put it on its
regular docket. This means we won’t get a snap decision, and
it means the matter won’t be declared moot just because the
Legislature may not be in session when the Court finally
does take up the case.
I’m pleased the Court will hear the case thoroughly and
completely. We are on track and moving forward.”
